Federal employees going through divorce

As many Houston area residents know, federal government employees often have generous retirement benefits. For those residents going through a divorce, it is critical to know how those retirement accounts and other federal benefits can be handled by the court system.

There are different ways that a federal employee's retirement benefits can be handled in a divorce. The court can award a percentage to the ex-spouse to divide the property or they can also award benefits to the children.

The final divorce agreement will spell out how the retirement benefits are to be handled. It will say that the employee is giving up a share of their retirement. If it is not mentioned in the divorce settlement, then the employee will keep all of their retirement benefits. The ex-spouse will not get to collect any of the retirement benefits until the employee retires.

Survivor benefits can also be awarded to the ex-spouse of a federal employee. But if the spouse remarries, then they lose these benefits that were awarded in the divorce. The federal employee may also be ordered to assign the life insurance to their ex-spouse and keep them on the health care policy. The ex-spouse may also be entitled to a death benefit if the federal employee dies.
