Modification of Child Support Orders

There are many valid reasons why a child support modification may be requested. If the parent paying support, usually the non-custodial parent, sees a substantial decrease or increase in income, the court may allow modification of amount of child support. If the child needs brace, for example, or requires mental health counseling that is not covered by insurance, the custodial parent may request child support modification.

If circumstances change, lawyer Christine Lincoln recommends you act quickly. If you have lost your job, you cannot reduce your child support payments until the court orders child support modification. A family law lawyer can provide support and legal advice, which can be helpful in speeding up the child support modification process.

Modification of Child Custody or Visitation

Like child support modification, the court looks for substantial changes in circumstances before approving modification of child custody. If one parent is offered a job in a distant city, it may be in his or her best interest to modify the child custody and visitation arrangements in order to maintain their relationship with their child.

The court also considers modifications if the custodial parent begins using recreational drugs or begins working a night shift, leaving the child or children unsupervised.

If you are requesting modification of child custody, you must prove that you would be the more qualified parent, providing support at home and at school.
