Conservatorship in Texas
Conservatorship is the legal term to describe what is commonly known as custody in the state of Texas. Typically the mother and father of a child are conservators, but grandparents or adoptive parents can become conservators as well. The conservator is responsible for caring and making decisions for children. Joint managing conservatorship is not the amount of parenting time or visitation, rather the ability to make decisions for a child involving such matters as education and health care. Joint managing conservatorship is presumed to be in the child's best interest after a divorce; however, other arrangements are available depending on the circumstances.
Expert Resources to Protect Your Rights
When necessary, we work with experts, including custody evaluation advisors who can testify to the best interests of the child in your case. When considering a proper custody arrangement, the courts will look at:
- Which parent had caretaking responsibilities
- Any drug or alcohol use
- Dangers to children
If you want sole custody or conservatorship, or if you want to prevent losing your custodial or conservator rights, it is important to consult with an experienced attorney as soon as possible. Christine Lincoln will provide the support advocacy and counsel you need to protect yourself and the best interests of your children.
