Collaborative Law

Collaborative Law is a process where the husband, wife and both their attorneys agree to resolve all issues in their case without involving a court. They work together, in private, to find a way to meet each individual's needs so that the couple may make a smoother transition from being married to being single.

Studies have shown that it isn't the divorce itself that has adverse effects on children but rather the tension and conflict between the parents that does.  The collaborative process seeks to reduce the amount of stress between the parties, which in turn benefits the children. 

The collaborative law process involves open communication between the parties and their respective lawyers and primarily entails informal discussions and group meetings.  Collaborative law attorneys are specially trained in interest-based negotiation and focus on meeting their clients' needs, goals, and desires.

Collaborative law seeks to help both parties feel safe, in control of their lives, and as comfortable as possible while collaborating towards resolution.  All of the participants agree to work together respectfully, honestly, and in good faith to try to find "win-win" solutions to meet the needs of both parties.  Your spouse and his or her attorney are treated as part of a settlement team, not adversaries.

Some advantages of the collaborative law process are:

  • Avoid court and any unnecessary fighting
  • You are in charge, nothing happens unless you agree to it
  • Adaptable process and creative solutions not confined to the law model
  • All time and money is spent on settlement efforts which typically makes the process less costly for those involved
  • Parties develop options for resolution in joint meetings
  • Parties avoid an adversarial atmosphere
  • Helps minimize adverse effects on children

There is no pain-free way to end a marriage, but by reducing stress, working in a climate of cooperation, and treating each other with respect, you and your spouse can create an environment in which you and your children can thrive.
